Thus, the legislator\u2019s intention with this measure \u2014alongside the introduction of appropriate means of dispute resolution in civil matters \u2014is to correct the dysfunctions that have led into the current, unsustainable backlog of judicial proceedings.<\/span><\/p><p><span style=\"font-weight: 400;\">The purpose of this note is not to analyze whether the measures introduced by Organic Law 1\/2025 are the most suitable to achieve the legislator\u2019s stated goal, but rather to summarize the main changes made to the organization of our Courts and Tribunals. This issue, despite its undeniable importance, has to some extent been overshadowed by the impact of the introduction of alternative dispute resolution mechanisms in civil litigation.<\/span><\/p><p><span class=\"s1\" style=\"color: #000000;\"><b>1. The New Courts of First Instance<\/b><\/span><\/p><p class=\"p3\"><span style=\"font-weight: 400;\">The main reform introduced by Organic Law 1\/2025 regarding judicial organization is the <span style=\"color: #800000;\"><strong>creation of the Courts of First Instance<\/strong> <\/span>(\u201c<\/span><i><span style=\"font-weight: 400;\">Tribunales de Instancia<\/span><\/i><span style=\"font-weight: 400;\">\u201d) to replace the current single-judge courts (\u201c<\/span><i><span style=\"font-weight: 400;\">Juzgados unipersonales<\/span><\/i><span style=\"font-weight: 400;\">\u201d). In this way, every judge will become part of the new Courts of First Instance.<\/span><\/p><p><span style=\"font-weight: 400;\">The Courts of First Instance are judicial bodies organized in a collegial manner, <strong><span style=\"color: #800000;\">comprising various Sections.<\/span><\/strong> These courts are governed by Articles 84 et seq. of Organic Law 6\/1985, of July 1st, on the Judiciary (the &#8220;<\/span><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1985-12666\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #800000;\"><b>LOPJ<\/b><\/span><\/a><\/span><span style=\"font-weight: 400;\">&#8220;).<\/span><\/p><p><span style=\"font-weight: 400;\">Article 84 of the LOPJ provides that there will be one Court of First Instance per judicial district, and it will consist of either a Single Civil and Investigative Section or separate Civil and Investigative Sections.<\/span><\/p><p><span style=\"font-weight: 400;\">In addition, the Court of First Instance may include one or more of the following sections:<\/span><span style=\"font-weight: 400;\"><br \/><\/span><b><i>(i)<\/i><\/b><span style=\"font-weight: 400;\"> Family, Children, and Capacity; <\/span><b><i>(ii)<\/i><\/b><span style=\"font-weight: 400;\"> Commercial; <\/span><b><i>(iii)<\/i><\/b><span style=\"font-weight: 400;\"> Gender-based Violence;<\/span><span style=\"font-weight: 400;\"><br \/><\/span><b><i>(iv) <\/i><\/b><span style=\"font-weight: 400;\">Violence against Children and Adolescents; <\/span><b><i>(v) <\/i><\/b><span style=\"font-weight: 400;\">Criminal; <\/span><b><i>(vi) <\/i><\/b><span style=\"font-weight: 400;\">Juvenile; <\/span><b><i>(vii) <\/i><\/b><span style=\"font-weight: 400;\">Prison Supervision; <\/span><b><i>(viii)<\/i><\/b><span style=\"font-weight: 400;\"> Administrative Litigation; and<\/span><b><i> (ix) <\/i><\/b><span style=\"font-weight: 400;\">Labour. Articles 85 et seq. of the LOPJ regulate the subject matters over which each Section of the Court of First Instance will have jurisdiction.<\/span><\/p><p><span style=\"font-weight: 400;\">Some Sections of the Courts of First Instance may extend their jurisdiction to several judicial districts within the same province or neighboring provinces. Most commonly, the Commercial, Criminal, Juvenile, Prison Supervision, Administrative Litigation, and Labour Sections will have province-wide jurisdiction and be headquartered in the provincial capital.<\/span><\/p><p class=\"p1\"><span class=\"s1\"><span style=\"font-weight: 400;\">A notable innovation in the functioning of the Courts of First Instance has also been introduced. Organic Law 1\/2025 provides that, although cases will typically be assigned to a judge on a rotating basis, <strong><span style=\"color: #800000;\">two additional judges may be appointed to hear a case jointly with the judge initially assigned<\/span><\/strong>, when warranted by the volume, complexity, or number of parties involved. <\/span><\/span><\/p><p><span style=\"font-weight: 400;\">The transformation of the current single-judge courts into Courts of First Instance<\/span> <span style=\"font-weight: 400;\">will take place in stages, in the following order:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #800000;\"><b>First<\/b><\/span><span style=\"font-weight: 400;\">, on <\/span><span style=\"color: #800000;\"><strong>1 July 2025<\/strong><\/span><span style=\"font-weight: 400;\">, the Courts of First Instance and Investigation, as well as the Gender-based Violence Courts, will be transformed into Unified Civil and Investigation Sections and Gender-based Violence Sections in those judicial districts where no other type of court exist.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><strong><span style=\"color: #800000;\">Subsequently<\/span><\/strong><span style=\"font-weight: 400;\">, on <\/span><span style=\"color: #800000;\"><b>1<\/b> <b>October 2025<\/b><\/span><span style=\"font-weight: 400;\">, the Courts of First Instance, Investigation Courts, and Gender-based Violence Courts will be transformed into Civil Sections, Investigation Sections, and Gender-based Violence Sections in those judicial districts where no other type of court exist.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"color: #800000;\"><b>Finally<\/b><\/span><span style=\"font-weight: 400;\">, on <\/span><span style=\"color: #800000;\"><b>31<\/b> <b>December 2025<\/b><\/span><span style=\"font-weight: 400;\"><span style=\"color: #800000;\">,<\/span> the remaining courts will be transformed into their respective Sections.<\/span><\/li><\/ul><p><span style=\"color: #000000;\"><strong><span class=\"s1\">2. <\/span><\/strong><strong><span class=\"s1\"><b>The Central Court of First Instance<\/b><\/span><\/strong><\/span><\/p><p><span style=\"font-weight: 400;\">Following the reform, the LOPJ also regulates the so-called <\/span><b><span style=\"color: #800000;\">Central Court of First Instance<\/span> <\/b><span style=\"font-weight: 400;\">(\u201c<\/span><i><span style=\"font-weight: 400;\">Tribunal Central de Instancia<\/span><\/i><span style=\"font-weight: 400;\">\u201d), which replaces the current Central Courts (<\/span><i><span style=\"font-weight: 400;\">\u201cJuzgados Centrales<\/span><\/i><span style=\"font-weight: 400;\">\u201d).<\/span><\/p><p><span style=\"font-weight: 400;\">The Central Court of First Instance is now governed by <\/span><span style=\"color: #800000;\"><b>Article 95 of the LOPJ<\/b><\/span><span style=\"font-weight: 400;\"> and will comprise the following Sections: Investigation Section, Criminal Section, Juvenile Section, Prison Supervision Section and Administrative Litigation Section.<\/span><\/p><p><span style=\"font-weight: 400;\">The Central Court of First Instance will be formally established on <\/span><span style=\"color: #800000;\"><b>31 December 2025<\/b><\/span><span style=\"font-weight: 400;\"><span style=\"color: #800000;\">,<\/span> through the transformation of the current Central Courts into Sections of the Central Court of First Instance.<\/span><\/p><p><span class=\"s1\" style=\"color: #000000;\"><b>3. The Justice Offices<\/b><\/span><\/p><p><span style=\"font-weight: 400;\">The creation of <\/span><span style=\"color: #800000;\"><b>Justice Offices<\/b><\/span><span style=\"font-weight: 400;\"> in the municipalities is, according to the preamble of Organic Law 1\/2025, one of the key measures aimed at achieving greater efficiency in the judicial system.<\/span><\/p><p><span style=\"font-weight: 400;\">The Justice Offices are defined in Organic Law 1\/2025 as units within the organizational framework of the Administration of Justice, established to provide certain services to citizens in a given municipality. However, they are not part of the Judicial Office of the corresponding judicial district. A Justice Office will be established in every municipality that does not have a Court of First Instance.<\/span><\/p><p><span style=\"font-weight: 400;\">These Justice Offices will offer citizens a much wider range of services than those currently provided by the Justice of the Peace Courts. Their functions will include: assisting local justices of the peace in their assigned duties, carrying out procedural communications, cooperating with the Civil Registry and dispute resolution units, handling requests from citizens related to the administration of justice, and receiving applications for legal aid and forwarding them to the local Bar Associations.<\/span><\/p><p><span style=\"font-weight: 400;\">The staff of the Justice Offices will mainly be drawn from the Justice Administration, although the inclusion of staff from other public administrations is also contemplated.<\/span><\/p><p><span class=\"s1\" style=\"color: #000000;\"><b>4. Judicial Offices and the distribution of cases in the Courts of First Instance<\/b><\/span><\/p><p><span style=\"font-weight: 400;\">The modifications introduced by <\/span><span style=\"color: #800000;\"><b>Organic Law 1\/2025<\/b><\/span><span style=\"font-weight: 400;\"> also have a significant impact on the organization of the <\/span><span style=\"color: #800000;\"><b>Judicial Offices<\/b><span style=\"font-weight: 400;\">.<\/span><\/span><\/p><p><span style=\"font-weight: 400;\">The activities of these offices will be carried out through common processing services and other common services that may be stablished. These common services may provide support to one or more Courts of First Instance, as well as to national, regional, or provincial bodies.<\/span><\/p><p><span style=\"font-weight: 400;\">The direction of the service will be entrusted to a <\/span><b><span style=\"color: #800000;\">Lawyer of the Administration of Justice<\/span> <\/b><span style=\"font-weight: 400;\">(\u201c<\/span><i><span style=\"font-weight: 400;\">Letrado de la Administraci\u00f3n de Justicia<\/span><\/i><span style=\"font-weight: 400;\">\u201d), who will be functionally responsible for other lawyers and staff assigned to the Judicial Office.<\/span><\/p><p><span style=\"font-weight: 400;\">The Lawyer of the Administration of Justice who directs the Judicial Office will be in charge of distributing cases among the various judges of a Court of First Instance under the supervision of the Court&#8217;s president.<\/span><\/p><p><span style=\"font-weight: 400;\">The distribution of cases will be carried out in accordance with publicly approved distribution rules, which will be approved by the <\/span><span style=\"color: #800000;\"><b>Governing Chamber<\/b><\/span><span style=\"font-weight: 400;\"> of the <\/span><span style=\"color: #800000;\"><b>High Court of Justice<\/b><\/span><span style=\"font-weight: 400;\"> (\u201c<\/span><i><span style=\"font-weight: 400;\">Tribunal Superior de Justicia<\/span><\/i><span style=\"font-weight: 400;\">\u201d) on a proposal by the <\/span><span style=\"color: #800000;\"><b>Judges\u2019 Board<\/b><\/span><span style=\"font-weight: 400;\"> of each Section of the Court of First Instance.<\/span><\/p><p class=\"p5\" style=\"text-align: center;\"><span class=\"s1\">*****<\/span><\/p><p><span style=\"font-weight: 400;\">Madrid, on the 8 of May, 2025.<\/span><\/p><p class=\"p6\"><a href=\"https:\/\/marcellocarames.com\/en\/\"><span class=\"s1\">Marcello Caram\u00e9s Abogados, S.L.P<\/span><\/a><\/p><p class=\"p8\"><span class=\"s7\"><a href=\"mailto:info@marcellocarames.com\">info@marcellocarames.com<\/a><\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Organic Law 1\/2025, of January 2, on measures regarding the efficiency of the Public Justice Service (\u201cOrganic Law 1\/2025\u201d), , has recently entered into force, bringing with it a significant reform of the structure of the judicial system.
